Terms of Use
Last updated: August 28, 2026
These Terms of Use (“Terms”) form a binding agreement between you (“you” or “User”) and Vineyard Greetings, Inc. d/b/a Snapption (“Snapption,” “we,” “us,” or “our”), governing your access to and use of the website located at snapption.com and related applications and features (collectively, the “Service”). By creating an account, accessing, or using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. If you are between 13 and the age of legal majority in your jurisdiction, you may use the Service only with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf.
2. The Service
Snapption lets you upload photos and generates AI-assisted metadata — titles, descriptions, captions, and keywords — intended for stock photography submissions and social media posts. Output is generated automatically and may not always be accurate; you’re responsible for reviewing and editing it before you use or publish it. We may modify, suspend, or discontinue any part of the Service at any time, with or without notice.
3. Your Account
You sign in to Snapption through our authentication provider (Clerk), including via Google Sign-In. You’re responsible for keeping your sign-in credentials secure and for activity that happens under your account, except to the extent caused by our own breach of these Terms. Notify us promptly at the contact address below of any unauthorized use of your account.
4. Your Content
You retain ownership of the photos you upload. By uploading a photo, you confirm you have the right to use it and to submit it for AI processing, and you grant us the limited right to process it (including sending it to our AI provider) solely to generate the output you requested. See our Privacy Policy for how uploaded photos are handled — Snapption does not store your uploaded photos or share them with other users. You agree not to upload photos that are illegal, infringe someone else’s rights, or that you don’t have permission to use.
5. Acceptable Use
You agree not to, and not to assist or permit any third party to:
- Upload content that is unlawful, defamatory, obscene, or that exploits or endangers minors;
- Infringe or misappropriate any copyright, trademark, trade secret, right of publicity or privacy, or other intellectual property right;
- Upload viruses, malware, or other harmful code, or attempt to disrupt or gain unauthorized access to the Service or our systems;
- Scrape, crawl, or use automated means to access the Service except as we permit;
- Circumvent usage limits, or use the Service for any unlawful purpose.
We may investigate and take appropriate action against anyone who violates this section, including suspending or terminating accounts.
6. AI-Generated Output
Titles, descriptions, captions, and keywords are generated by an AI model (Anthropic’s Claude) and provided “as is,” without any guarantee of accuracy, completeness, or fitness for a particular stock library’s submission requirements. You’re responsible for reviewing generated content before relying on, publishing, or submitting it.
7. Intellectual Property of Snapption
The Service, including its software, design, text, graphics, and the “Snapption” name and marks (excluding your content), is owned by Snapption or our licensors and is protected by copyright, trademark, and other intellectual property laws. No rights are transferred to you except the limited right to use the Service as intended.
8. Copyright Complaints (DMCA)
If you believe material available through the Service infringes your copyright, contact us at the address in Section 12 with enough information to identify the work, the allegedly infringing material, your contact information, and a statement, under penalty of perjury, that you are authorized to act on the copyright owner’s behalf.
9. Termination
You may stop using Snapption at any time. We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms.
10. Disclaimers
THE SERVICE AND ALL OUTPUT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT AI-GENERATED OUTPUT WILL BE ACCURATE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SNAPPTION AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED US $10. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
12. Indemnification
You agree to defend, indemnify, and hold harmless Snapption and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your access to or use of the Service, your content, or your violation of these Terms or applicable law.
13. Governing Law and Venue
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles, except where applicable law requires otherwise. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Dukes County, Massachusetts, and you consent to personal jurisdiction there.
14. General
- Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Snapption regarding the Service.
- Severability. If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect.
- No Waiver. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
- Assignment. You may not assign or transfer these Terms without our prior written consent; we may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.
15. Changes to These Terms
We may update these Terms from time to time. We’ll update the “Last updated” date above when we do. Continuing to use Snapption after changes take effect means you accept the updated Terms.
